In connection with the program requirements for the reMBA program of the Western NY School of Real Estate, I hereby agree to the following
terms & conditions (including the Code of Ethics of the program):
1. I will not mislead the public or any other individuals that this designation is the equivalent to a collegiate degree of any type. 2. If I choose to use this designation after my name, it will be according to the following example and will not be altered in any such way, i.e. (John
A. Doe, reMBA). The program allows for the designation to be italicized if the designee wishes to do so. 3. I understand that this designation is a registered service mark with the United States Patent & Trademark office, appropriately registered by the
Western NY School of Real Estate and for the exclusive right and privilege of designated members who are in good standing with the program.
This privilege may be withdrawn by the School for violation of any of the terms of this agreement (or amended terms which may be made from time
to time). 4. If required by my State, I agree to maintain my professional education by at least attending one - three hour program every two years in
conjunction with my license renewal date. 5. I will reasonably cooperate with other licensees and not manipulate or frustrate the actions of
another to gain financial reward for myself or my company. 6. I will offer my opinion and do so as appropriate in an objective & professional manner
(uninfluenced by any personal motivation or gain). 7. I will treat others as I'd like to be treated in the course of any real estate related business or
transaction. 8. I will follow the real estate laws of my State or any State I do business in and will surrender my designation if I break any law
voluntarily at the first opportune moment. 9. I will treat all parties honestly in a real estate transaction as far as my fiduciary duties allow for keeping
my client's best interest in mind. 10. If my license is active, I will sign any real estate documents in such a way that identifies my position as a
licensee in accordance with State laws. 11. I will not mislead property owners whom I may be representing (either directly or indirectly) with regard
to what I believe their market value of their home is for any reason. 12. I will not mislead any party whom I may have an "agency" relationship with
(either directly or indirectly) to use my services over that of a potential or identified competitor - nor will I speak or act in any such way that would
be considered as unprofessional.13. If I am involved with a counter-offer, I will handle it expeditiously and professionally and handle
any monies in an equally professional manner taking into consideration the laws & my fiduciary responsibilities. 14. If I am involved with "showing"
properties, I will do so in a professional manner and follow my fiduciary responsibilities accordingly (this includes: consideration of confidential
information, disclosures as appropriate, etc.) 15. I will follow any signed agreement as stated including those for leases, listing agreements,
corporate policy objectives (if applicable), statutory forms for municipal bodies and appropriate State departments/divisions. 16. When handling
keys, I will sign them in & out as directed by our corporate policy and make sure that directions are followed accordingly when showing homes
listed for sale through my firm or that of other brokers in the State that I practice.
17. I agree to consider arbitration as an alternative means to resolve differences in my trade as a real estate professional providing that it is in my
best interest. 18. I will follow-up in writing as reasonably as possible for changes that are made in order to facilitate better communications between
myself and my client (and will keep copies of such correspondence in the file for future reference), as appropriate. 19. I will follow State & Federal
laws regarding non-discrimination programs for any & all protected classes. 20. I will not misrepresent when responsible for preparation of
advertising for property owners I represent. 21. I will not try to pursue the listing of a property that I know or suspect is still under an active
exclusive listing agreement. 22. If I am involved in a proceeding of any kind, I will not try to "frustrate" the efforts of the investigatory body - I agree
to cooperate and/or obtain legal advise as appropriate. 23. I will not practice law - If I make substantial changes to "pre-printed" forms or
documents, I will obtain attorney approval as appropriate for my venue. 24. I will not call myself a Realtor or Realtor-Associate(r) unless I am a
member in good standing with the National Association of Realtors (through my local board or affiliate) nor will I mislead the public as such. 25. I will not make public information about property owners or principal's I represent without their consent.
